Independent TD Michael Healy-Rae says he won't be enforcing the wearing of face masks in his shop.
Wearing masks and face coverings is mandatory in retail settings including shopping centres, hairdressers and libraries.
And people who don't comply could be fined up to 2,500 euro.
But Kerry TD Michael Healy Rae, who runs a petrol station and supermarket in Kilgarvan, doesn't think it's the job of shopkeepers to enforce the rules.
''I or anybody working for me will not be at the door saying to the person coming in, well you're not allowed in here if your don't wear a face mask'', he said.
''Of course we have the signs up reminding people that it is mandatory, we are highly recommending to people that they do obey.
''But we're not enforcers of the law''.
